In the name of God. Amen:

 

I, John W. Swilling of the County of Yavapai, Territory of Arizona being of sound and disposing mind and memory, and not acting under duress, menace, fraud or under influence of any person whatever, do make, publish and declare this my last Will and Testament, in manner following, that is to say;

 

First. I direct that my body be decently buried with proper regard to my station and condition in life and the circumstances of my estate.

 

Second. I direct that my funeral expenses, and the expenses of my last illness and all my just debts be first paid.

 

Third. I do give and devise unto Patrick McAteer of Kirkland Valley in said County of Yavapai, all of my property of every kind, nature and description, my Ranches, live stock, interest in Mines and Mining property, water rights and all my personal property in trust, for the uses and purposes following, that is to say: It is my will and my intention that my daughter Georgia Swilling now twelve years of age shall have all of my said property in her own right when she shall have attained the age of Eighteen years, and I hereby direct said McAteer, to make due and proper conveyances of said property to said Georgia Swilling, when she shall have attained said age of Eighteen years. In case of the death of said Georgia Swilling before she shall have attained said age of Eighteen years, then and in such case it is my will and my desire that my other daughter Lelia the happening of the event – last above stated, and when my said daughter

 

Lelia, shall have attained said age of Eighteen year, I direct the said McAteer to make due and proper conveyances of my said property to said Lelia Swilling.

 

Fourth. I hereby nominate and appoint the said Patrick McAteer the sole executor of the my last Will and Testament, and request that he may so act, without being requested to give any bonds – as I do hereby waive the giving of any bonds by my said executor.

 

Fifth. I do herby revoke all former Will by me made.

 

In Witness Whereof I have hereunto set my hand and seal this Twenty fifth day of June A.D. 1877.
